1) Seeking all email correspondence by any city employees in regards to request number 2021-0876, if attachments exist - send them.   We are requesting any email in relation to this request however the reason we are asking is the irregularity in the response because the city made the choice to not make the response public.   This request was in relation to city business and not confidential police reports.  Therefore we find is challenging to understand why it was chosen to not be made public. 2) We ask for any internal FOIA or Public Records Request policy, handbook, guide, directives, published, or written as part of an email, by any person of authority, by any director, by any RAO or SRAO, or by any attorney working as the city solicitor, or on behalf of him.   As per the FOIADirect application, it does not make a document “Public” just by uploading it. One has to attach that document in “Response Email” and then those attached documents only become “Public”. Unfortunately, that didn't happen. We re-opened the records request, attached the documents, and re-sent it, with an explanation. 3 Documents attached from SRAO Four of the emails responsive to your request have been partially redacted.  The emails include legal advice sought and received by various City officials from the Framingham City Solicitor’s Office, specifically Chris Petrini and/or Amanda Zuretti.  The legal advice reflected in the emails was sought and given in confidence, and the privilege to such advice has not been waived by the City.  Such portions of the emails are exempt from disclosure under the common law attorney-client privilege recognized in Suffolk Construction v. DCAM 449 Mass. 444 (2007).  The dates, the names of the author and recipient and the general subject of the privileged communications are set forth in the emails themselves.   You have a right to appeal this response by filing an appeal with the Supervisor of Public Records or by filing an action in Superior Court.
