Under the Massachusetts Public Records Law, the digital news media outlet is requesting a list of all businesses in the City of Framingham that reported an employee that tested positive for COVID-19 in February 2021.
The city has been compiling this in a spreadsheet, and thus the news media outlet is requesting that spread sheet minus any names of individual employees. Under Dr. Wong, the City supplied that spreadsheet in November & December 2020.
As of March 1, the City of Framingham has yet to supply the news media outlet with the data for January 2021, despite a FOIA filed on February 1, 2021.
Employers that have an employee that tests positive for the coronavirus, are required to report this to and cooperate with your local board of health," said Massachusetts Secretary of Housing and Economic Development Mike Kennealy in a letter to the state's employers.
As a representative of the news media, SOURCE requests a waiver of all fees for this request.
Disclosure of the requested information to the news outlet is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government during this pandemic.
The Public Records Law requires you to provide me with a written response within 10 business days.
If you cannot comply with my request, you are statutorily required to provide an explanation in writing.
The Health Department has attached all the documents regarding this request.
Pursuant to MGL Chapter 4 Section 7 Clause 26 (C) I have redacted the applicants home address, city, state, zip code, email address and telephone number. The reason being is the sited statue says in part “…information, also any other materials or data relating to a specifically named individual, the disclosure of which may constitute and unwarranted invasion of personal privacy.” Those things redacted fit into this category.
