Summary

Under the Freedom of Information Act, SOURCE media is seeking all texts by the City's Chief Operating Officer Thatcher Kezer on his work or person phone for the following time periods: Tuesday, October 6 between 5 p.m. and 11 p.m. Tuesday, September 29, between 5 p.m. and 11 p.m. Tuesday, September 15 between 5 p.m. and 11 p.m. Tuesday, September 3, between 5 p.m. and 11 p.m.  If personal cell phone are used to conduct city business, please be advised the state and the FOIA law consider those texts to be public as well. It is the news media's understanding that some city employees have been using their personal cell phones during COVID. The COO specifically mentioned during the October 6 meeting that he was texting with the City's Human Resources director, so there is evidence he texts during City Council meetings. As a representative of the news media, SOURCE requests a waiver of all fees for this request.  Disclosure of the requested information to the news outlet is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government during this pandemic.  The Public Records Law requires you to provide me with a written response within 10 business days.  If you cannot comply with my request, you are statutorily required to provide an explanation in writing.
