We are looking for all emails, texts, phone calls, between Yvonne Spicer, Thatcher Kezer and anyone else regarding EPA and DEP reports regarding Cedar Woods and the contamination. Including any, and all, notifications of the extent of fencing off of the contaminated area, restricting public access. Also, copies of the reports from the DEP and EPA need to be provided as to their findings. The date range should be between 1/1/2020 and the present.
This FOIA has been submitted on behalf of a concerned resident.
Due to space constraints, the Health
Department no longer maintains hard copy files related to sites and releases
regulated by the MassDEP. The MassDEP maintains a searchable database that is
available to the public and the Health Department utilizes this database to
access hazardous waste and material related files. The vast majority of
files that have been submitted to the MassDEP, with the exception of some old
files, are available on the database. The Release Tracking Number (RTN)
assigned to the contamination reported at a portion of Cedar Woods
(specifically, 618R Waverly Street) is 3-36304. All reports that have
been submitted to the MassDEP related to 3-36304 can be found at the link
below.

I do not believe that any reports
related to this property have been submitted to the EPA. Reports submitted to
the EPA would be related to the Brownfields grant and work related to the site.
The Brownfields grant is being administered by Planning and Community
Development and they can better answer the question about reports submitted to
the EPA.
The City is withholding certain email
communications with the City Solicitor’s Office which are otherwise responsive
to your request under the common law attorney-client privileged recognized in
Suffolk Construction v. DCAM, 449 Mass. 444 (2007), and which were made in
confidence between the City and its counsel for the purposes of seeking/giving
legal advice.
