Summary
June 16, 2020 Dear Public Records Officer, Under the Massachusetts Public Records Act § 66-10 et seq., I am requesting copies of the following Framingham Police policies, which, according to PIO Kelly McFalls, are already written department policy. I am also requesting the date each of the following policies was adopted by the department. The Framingham Police Department shall require officers to de-escalate situations, where possible, by communicating with subjects, maintaining distance, and otherwise, with the goal of eliminating the need to use force whenever possible. The Framingham Police Department shall prohibit the use of chokeholds and strangleholds, including carotid restraints, except where deadly force is authorized and there is no alternative.  The Framingham Police Department shall require any police officer to exhaust all other alternatives, including non-force and less lethal force options, prior to resorting to deadly force. The Framingham Police Department shall require officers to intervene and stop excessive force used by other officers and to immediately report these incidents to a supervisor.  I prefer this data be sent to me in a machine-readable format.  If there are any fees for searching or copying these records, please inform me. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest. This information is not being sought for commercial purposes and will be used in a piece I’m writing for The MetroWest Daily News. The Massachusetts Public Records Act requires a response to this request within 10 days.  If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records. If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.
