Summary

I am seeking a copy of the 9-1-1 call from today, October 18 at about 11 a.m. from the mother who called with her baby not breathing. Enclosed please find a redacted version of the audio file for the E-911 call responsive to your public records request of October 18, 2017.  The audio has been redacted pursuant to G.L. c. 4, §7, cl. 26th, exemption (c), which exempts “personnel and medical files or information; also any other materials or data relating to a specifically named individual, the disclosure of which may constitute an unwarranted invasion of personal privacy” from the definition of public records.  Portions of the call discuss the medical condition and treatment of an individual, which is medical information.  Consequently, those portions have been removed from the audio file of the call pursuant to exemption (c) and are being withheld from the Town’s response to your request. Please note that you have a right to appeal the Town’s response to your request through the administrative process provided by the Supervisor of Public Records in 950 CMR 32.08 as well as by instituting a civil action in the superior court pursuant to G.L. c. 66, § l 0A.
