Per the Supervisor of Records’ August 17, 2020 determination of appeal
SPR20/1294 (attached) of the Town’s original response to your July 6th
request, Public Record Request Number 2020-0076, I am producing the original
response documents with further explanation.
The referenced equipment and service was purchased through State
Contracts. Information related to these contracts is attached along with
purchase price documentation. The Town is not in possession of any other responsive
documents.
Exemption (b) permits the withholding of:
records related solely to internal personnel rules
and practices of the government unit, provided however, that such records shall
be withheld only to the extent that proper performance of necessary
governmental functions requires such withholding
M.G.L. c.4, §7(26)(b)
In the requester’s previous appeal SPR20/0210, the Supervisor of Records determined
that the Town may make redactions under Exemption (b), of phone numbers for Town
personnel whose duties involve law enforcement and emergency response.
Therefore, wireless device numbers for the Town Manager are redacted in the
responsive documents under Exemption (b) as he is an employee whose duties
involve emergency response.
You may appeal this response to the Supervisor of Public Records pursuant to
950 CMR 32.08(1)(d). By law, the Supervisor is required to respond within
10 business days of receipt of your appeal. You may also seek judicial
review of an unfavorable response by commencing a civil action in the superior
court, under G.L. c. 66, §10A(c).
