The redactions made to the invoices were made pursuant to Exemption (c) of the Public Records law.  Exemption (c) permits a custodian to withhold records that constitute: Personnel and medical files or information; also any other materials or data relating to a specifically named individual, the disclosure of which may constitute an unwarranted invasion of personal privacy.  G.L. c.4, §7, cl.26(c) Records constituting “personnel” records, i.e., information with regard to a particular employee may be withheld as “personnel information” under the first clause of exemption (c) of the Public Records Law.   Wakefield Teachers Association v. School Committee of Wakefield, 431 Mass. 792, 798 (2000).  Personal information regarding a particular individual will be withheld from disclosure pursuant to the second clause of exemption (c), which provides that a records custodian may withhold from disclosure records “relating to a specifically named individual, the disclosure of which may constitute an unwarranted invasion of personal privacy.”  Determinations as to whether particular records or portions thereof may be withheld pursuant to this provision must be made on a case by case basis, requiring a balancing of the public's right to know against the relevant privacy interests at stake.  Attorney General v. Assistant Commissioner of the Real Property Department of Boston, 380 Mass. 623, 625 (1980).  The redacted portion of the bills involve material that identifies a particular employee, the disclosure of which may constitute an unwarranted invasion of personal privacy.  As such, the responsive record have been redacted accordingly.  You may appeal this response to the Supervisor of Public Records pursuant to 950 CMR 32.08(1)(d).  By law, the Supervisor is required to respond within 10 business days of receipt of your appeal.  You may also seek judicial review of an unfavorable response by commencing a civil action in the superior court, under G.L. c. 66, §10A(c).
